These Terms of Use (“Terms”) govern your access to and use of the Chalkline website, products, and services, and your participation in our mobile/SMS messaging and email programs. By using our website or services, or by opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use our services.
01Acceptance & Eligibility
By accessing or using our website and services, you represent that you are at least 21 years of age and able to form a binding contract. Our services are intended for businesses and individuals located in the United States. If you use the services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
02Use of the Services
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use our website and services for their intended purposes, subject to these Terms. We may modify, suspend, or discontinue any part of the services at any time.
03SMS / Mobile Messaging Terms
By opting in to Chalkline's text messaging program, you agree to these mobile messaging terms.
Program description
When you opt in to the service, we will send you SMS text messages that may include promotional and marketing messages about Chalkline products, offers, and events, as well as transactional messages such as confirmations and customer support replies.
Consent
You agree to receive text messages only after providing your prior express consent, for example by submitting your mobile number through a Chalkline web form, providing written or verbal consent, or texting a keyword to one of our program numbers. Consent is not a condition of any purchase.
Frequency and cost
- Message frequency varies.
- Message and data rates may apply. Any such charges are billed by and payable to your mobile service provider. Please contact your carrier for details about your plan.
Cancellation and help
You can cancel the SMS service at any time by texting STOP. After you send STOP, we will send a confirming message and will no longer send you SMS messages. To rejoin, sign up again as you did initially. For help, reply HELP for assistance or contact us at privacy@chalkline.com.
Carriers and delivery
Delivery of messages is subject to effective transmission by your mobile service provider and is outside our control. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice, and message delivery is not guaranteed on all carriers.
Privacy
Your mobile information is handled in accordance with our Privacy Policy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
04Email Communications
By providing your email address, you consent to receive emails from us, which may include marketing communications. Every marketing email includes an “unsubscribe” link, and you may opt out of marketing emails at any time. We process opt-out requests in accordance with the CAN-SPAM Act and other applicable laws. We may continue to send transactional or service-related emails after you opt out of marketing.
05Acceptable Use
You agree not to: (a) use the services for any unlawful purpose; (b) interfere with or disrupt the services or related infrastructure; (c) attempt to gain unauthorized access to any system or data; (d) reverse engineer or copy any part of the services except as permitted by law; or (e) use the services to send unsolicited or unlawful communications.

The website, services, and all related content, trademarks, logos, and software are owned by Chalkline Sports, Inc. or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
07Third-Party Links
Our services may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party. Accessing third-party sites is at your own risk.
08Disclaimers
The services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, secure, or error-free.
09Limitation of Liability
To the maximum extent permitted by law, Chalkline and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the services. Our total liability for any claim arising out of these Terms or the services will not exceed one hundred U.S. dollars (US$100).
10Indemnification
You agree to indemnify and hold harmless Chalkline Sports, Inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the services or your violation of these Terms.
11Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in that state.
12Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the services after changes take effect constitutes acceptance of the revised Terms.
